
Syndicated Elitist had filed a federal civil lawsuit against KCTalk.com's owners Frank Arena, Jeff Hirst and Aaron Case for violating the Digital Millennium Copyright Act.
We filed the suit because a number of items on KCTalk.com were copyrighted items owned by us and we noticed a number of items which were owned by other companies and after requesting the material to be removed the owners initially refused.
Frank Arena advised me that in order to settle the matter and avoid any civil penalties that all content owned by Syndicated Elitist had been promptly removed upon becoming aware of a lawsuit.
Monitoring of this forum site will continue to ensure legal compliance and on a side note it seems the users at KCTalk.com are currently disturbed with the owners for their practices of not allowing users to express opinions or have a real discussion without the risk of ban or other sanctions.

Google's Blogger Team is currently developing a dozen new features for blogger and some cosmetic changes to Dashboard. The current word is that the new features and look will become public in late June or early July.
Some of the yet confirmed features are Comment Spam Protection, On/Off for Nofollow tag and a few other handy settings. Kudos to the Blogger Team for this upcoming release.

House Speaker Nancy Pelosi toured the San Francisco VA (Veteran Affairs) Medical Center this afternoon to get a first hand look at the medical center's facilities and treatment for PTSD (Post Traumatic Stress Disorder).
Speaker Pelosi during the press conference on the main steps of the center stated that the San Francisco Medical Center was the best in the country for treating this disorder and that congress is working to increase funding for veterans.
A number of veterans of various wars prior to the Iraq War were disappointed that Speaker Pelosi had time to talk with the media but did not speak directly with the veterans who were prevented from asking questions by VA Police and U.S. Secret Service.
Some of the questions the veterans had to ask is why Vietnam Veterans have such difficulty receiving treatment and benefits for Post Traumatic Stress Disorder while Iraq and Afghanistan veterans are being treated and provided benefits nearly automatically upon returning from war.
My father-in-law who was present during the press conference served in the United States Marine Corp and was one of a number of veterans interested as why the VA gives preferential treatment and services to more recent veterans while providing lessor care for veterans from older conflicts.
Members of the media and staff of the VA Hospital were provided the ability to ask questions of the Speaker while veterans were kept at a large distance by Secret Service and VA Police and Speaker Pelosi breezed by regular constituents and veterans and did not stop to answer any questions or address any concerns.

The 9th Circuit has approved a practice that Federal Agents had started doing prior to the court decision which is scanning laptops and cellphones and other portable electronic devices such as mp3 players and copying all data from them for storage and later analysis.
It is likely that in the future you will see agencies such as the U.S. Marshals and the Federal Protective Service that protect courthouses and other government buildings start this same practice in places other than airports and borders because essentially the court is saying that if federal agents can search your luggage why not your electronics?
While I think this raises a dozen or more privacy concerns and the most important is that what if protected legal documents are contained on a laptop that is searched? What if it is a lawyers laptop who happens to be suing the federal government then essentially a search by a federal agent would deprive that lawyer of his access to the courts under federal law.
The Battle Against Scientology!

I was privileged yesterday to occupy some time by watching a protest of the Church of Scientology at the Powell Bart Station in San Francisco, CA. The protesters were essentially protesting the tactics and practices of the Church of Scientology who that day were offering their well known "Free Stress Tests" at a table inside the station.
You may ask yourself why some much effort and time is put forth in the protest of the Church of Scientology?
If you were to go based on what the protesters have to say then it would be because the Church of Scientology has been fraudulently trying to con and convince innocent people into a financial scam by using "Free Stress Tests" as a front to then badger individuals into purchasing hundreds if not thousands of dollars worth of books, classes and more.
I have done some research in the Church of Scientology and I do have some previous firsthand knowledge as to this organizations operations. Many key members of the organization were charged criminally for acts that closely resemble espionage against the United States.
Now why does the Internal Revenue Service which in the past had revoked this organizations Tax-Exempt status now today honor that same status they had previously revoked? Was it a result of monetary bribes and threats of legal action?
The Church of Scientology has a host of movie stars and other celebrities who claim membership to this organization which is widely identified as a cult or tax-shelter. Just to name a few of the members such as Tom Cruise, John Travolta and many more.
The Church of Scientology owns a cruise ship which it sends its well off rich members on tax-free cruises around the world.
My photographer Jacklyn who is also an associate editor of this blog attempted to take some photos and speak with the Scientologists yesterday and she was in a rude manner told to go away now by a authoritative Scientologist.
I have been warned by several members of the Anonymous Protest group who regularly and vigorously protests the Church of Scientology that if I were to cover this event in a negative light or one that did not favor the Church of Scientology that I may risk Harassment, Lawsuit and possibly even assault. In fact one of the Anonymous Protester's who goes by the Moniker "BlueHair" was attacked by a Scientologist simply for protesting their "Free Stress Tests".
As of the time of publishing this article the Church of Scientology has not responded to my e-mail or phone calls requesting comment although during yesterday's event I spoke briefly with a Scientologist in a suit who told me he doesn't know "Jack" about what these protesters speak of.

In addition the Feeva employee also advised me that Google pulled out of the partnership after just a few months of working on the free WiFi project and that Feeva is the sole operator and provides all funding for the project.
Texas FLDS Seizure Found Illegal!

Just like I thought there was a finding of lack of evidence in the seizure of children from the FLDS (Fundamentalist Church of Jesus Christ of Latter Day Saints) and the children are being released back to the Fundamentalist Church of Jesus Christ of Latter Day Saints compound in Texas.
This will probably not result in a civil suit but if these FLDS people had any smarts they would bring a suit against that county and all involved parties who infringed on their rights.
Law Enforcement are not allowed to operate purely on rumor and must have substantial evidence. It seems like every week now you open a newspaper and a instance of civil rights being violation by law enforcement is ever so present.
Yearning For Zion Ranch in Eldorado is probably the last place on the planet I would want to vacation to or visit. I think that Warren Jeffs will eventually find some avenue for a successful appeal for his case aswell.
I think there were definately some awful and sick things happening to children at that compound however if I were a member of Law Enforcement I would have never operated of simple suspicion.
Google 411 (Goog-411) Technical Issues

Have you ever dialed 1800-Goog411? While if you haven't you should because its a free 411 service and its very nifty. Lately however Goog-411 has been consumed by a dozen or so technical issues and if you read my blog regularly you would note that I was the first person to report that Goog-411 discontinued calls to the service from Payphones.
However, Google has never intended for Goog-411 to be accessed from Payphone because the toll-free related fees from a payphone are extremely high and Google due to a technical error on their part forgot to block payphones or at least that is what "Gosia" a Google Spokeswoman told me via E-mail.
Goog-411 continues to have errors and bugs that plague the service its often that people entire a zip code of a popular city and Goog-411 will say "I don't recognize the zip code you entered".
I think Google needs to monitor their Mobile Help Group better to efficiently resolve these bugs. Or perhaps Google can use a Bugzilla like system.

Google WiFi Sucks!

If by chance you had not heard Google teamed up with Feeva to provide Free WiFi in San Francisco, CA in two locations one of them being Union Square. In Google's initial proposal to blanket the entire city Google cited it's already superb ability to provide ubiquitous fast search results worldwide in a matter of seconds and suggested that it could provide 1mbit connectivity in all areas of the City.
Although the City to my knowledge has yet to accept a proposal for the entire City to be blanketed with Wifi, Google pushed forward to offer service with Feeva. The result is not what you would expect from a service with the Google name attached to it.
Imagine dial-up provided to you in a wireless format and that is what the Google WiFi with Feeva essentially provides. You can be within 10-20 feet of the physical location that the signal is broadcasted from and you will have slow laggy connectivity and your connection is constantly dropped and most of the time it is slower than a 56k connection.
If you go to the Seattle's Best Cafe in Border's you could ask any person with their laptop or iPhone or other mobile device out how they feel about the WiFi service and they will outright describe it bluntly as a serious disappointment.
Feeva alone describes its company as a innovator in WiFi although with the partnership with Google they still cannot provide a solid WiFi service? I find it very unusual that small business such as Cafes and Motels and even the City Library can provide fast and stable WiFi!
Just on a side note I did try another Feeva/Google WiFi Hotspot in the Mission Bay near the Giants stadium and the service is excellent there so it seems like just the Union Square Feeva/Google hotspot is suffering from poor signal and horrible lag.
I e-mail Feeva's press and public affairs office to report the issues people are encountering in the Union Square location.

Syndicated Elitist is now fully compatible with the MobileSafari browser that is native to the iPhone and iTouch. I have been working hard to ensure that Syndicated Elitist continues to be as optimal and compliant as possible with each and every browser.
Thus far Syndicated Elitist is available via any device, platform, resolution etc.
Not many sites take the effort to ensure their sites ability to be viewed on mobile devices and various web browsers etc.
I personally tested out the new code I implemented into the Syndicated Elitist source code by loading the site via the iTouch I just bought my wife and comparing it will the view on my Dell 1525.
This week sometime I am also releasing a iPhone/iPhoto app using the Apple iPhone SDK and I have been working with some new data providers and Syndicated Elitist is now being constantly monitored 24/7/365 by five different analytic software's which I use to aggregate statistics and flow data to better improve my reader experience.
A special thanks to Mr. Kendall at the San Francisco, CA Apple store who was showing off Syndicated Elitist during the group Apple Tutorials today!
In early June my wife and I will be departing for a vacation we will be doing some hiking and camping at a state or national park which one has not been determined yet and during that vacation I will be either minimizing my posting on Syndicated Elitist or taking a short hiatus.

Frank Arena had been known for years on WebHostingTalk.com as a con artist who defrauded hundreds of people. He is now using copyrighted content from this blog and a dozen other sites without any permission or right to said content.
On behalf of a dozen newspapers and websites who are named plaintiffs in "ex parte" I filed a lawsuit against Frank Arena, Jeff Hirst and Aaron Case who are all doing business as KCTalk.com
This should bring a final chapter to this deceptive behavior by this trio!

It is known to most that Google has been expanding into the Health care field to provide a new service aimed at storing and managing health records of just about anyone. For the longest time this project was very secretive but Google just launched this project to the public.
In response to this new service a handful of hospitals and pharmacies have teamed up with Google Health to make this service work for more people.
There are even talks that UCSF in San Francisco may be the next hospital to work with Google Health. I urge everyone to start using this awesome service which I have been using for some time as I was selected as a private tester before the public release earlier today.
As more and more hospitals and pharmacies partner with the Google Health this service will eliminate more and more medical billing issues and also prevent costly malpractice issues and error in diagnosis.

I got my wife the 16GB Apple iTouch last night which retails at $399 before tax. I think she will be using this alot for photos and for checking her e-mail and such when she is on the go.
I am kind of jealous she is getting one but then again when I last visited the Apple Store I tried one out and its navigation via touch was a little difficult my fingers seem to big.
Anyways I will get some photos up here of me and my wife using this awesome little gadget once it arrives in the next couple days.

Have you ever wanted to form your own country and build it's laws and everything about it's government from the ground up?
Tired, of living in the United States or elsewhere and wanna be the person in charge? Well, in a few years that is likely to be reality if thanks to a donation by Peter Thiel to the Seasteading Institute which is posed to develop and construct floating structures which would then be colonized and governed as a mini-state or mini-government.
There have been a number of "Countries-in-a-Box" over the years such as Minerva and other loopholes which would allow individuals or groups of people to operate in no-mans land or international waters where no other country enforces laws.
If churches such as the Roman Catholic Church can have their own mini-country and government why can't you?
What would your country be like?

I just got a license for vBulletin 3.7 which retails at $160 and even owners of older license have to pay and upgrade fee. vBulletin 3.7 is loaded with amazing features and I cannot wait to implement it into my network of websites.
This blog and my other sites are getting a lot of attention and I am very appreciative of my readers and visitors who come from every corner of the globe on a daily basis.
I recommend any webmasters who have established websites who need a platform for forums to check vBulletin. Special thanks to the vBulletin/Jelsoft staff for their accommodations by providing me the license.

I searched long and hard and did research on a number of blogging community websites and used Google Search to come up with the following list of features that are most wanted on Blogger.
The most wanted features for Blogger:
- The ability to import your blog from another platform to Blogger
- Increase the amount of Image and Video storage allowed
- The ability to create static pages as a part of your Blogger blog
- The ability to have Main Labels and Sub Labels ie: Technology -> Programming
- Better integration of Google Docs Form system into Blogger
- More ability to control contribution through new levels Admin, Editor, Contributor etc.
- Include Spam Protection for Comments on Blogger Blogs... We hate Comment Spam!

Firefox 3 finally available! But wait don't download it yet!

Firefox 3 RC1 (Release Candidate 1) is available as of yesterday and the new version promises a dozen exciting changes and fixes.
If you were to believe what Mozilla has to tell you about Firefox 3 then you would expect a faster and more stable Firefox. I assure you that Firefox 3 RC1 is NOT stable and on most versions of Windows it is NOT any faster than the latest Firefox 2.x version.
My suggestion is to stick to your guns (stay with firefox 2.x) and wait it out until Mozilla has a more functional working version of Firefox. A number of people using Firefox 3 RC1 will tell you that it crashes more frequently than 2.x versions of Firefox and that is uses the same amount of Memory and CPU if NOT more on Windows Platforms.
I am a PRO-Firefox blogger in that I believe Firefox is the safest, easiest and cleanest browser on the market I just do not like the issues arising out of Firefox 3 RC1 so please for your own convenience stay with Firefox 2.x
And due to Mozilla releasing this buggy release candidate I will compensate you with this awesome looking model who is showing off her cute little Firefox shirt.
MySpace Suicide Case Will Result In Slap On The Wrist!

Primarily because when it comes down to it the indictment against Lori Drew alleges she violated various Federal Laws.
The U.S. Attorneys office's will almost always think up a dozen closely related statutes they think are broad enough to try you in court on but when it comes to the deadline to go to trial most prosecutors will be ready to bargain.
I imagine that Lori Drew will do less than five years in prison and in fact perhaps she will only due 12 months at most and if she has a good attorney then she may do no time at all.
Under the United States Code there is very little that Lori Drew could be convicted for in the MySpace Suicide case.
If you do research on federal cases all the news media will always say that a defendant is facing "x" amount of years but when it comes for sentencing time most defendant's do only a couple years at the most.
What really needs to happen is Congress needs to revise the Children's Online Privacy Protection Act (COPPA) and make it require that websites, web communities, ISP's and all Internet based entities be more responsible for the protection of minors while online.
In a case like this if there was a stronger version of COPPA and this still occurred not only should the predator be liable for both criminal and civil penalties but I believe MySpace or any Internet community should be liable for fines and restitution.
Osama Bin Laden urges muslims to destroy Gaza blockade!

Osama bin Laden, the leader of al-Qaeda, has allegedly called on Muslims to help end Israel's closure of the Gaza Strip, according to a new audio tape.
The true authenticity of the tape could not verified but the voice sounded the same as on other tapes attributed to bin Laden. It is our understanding that intelligence agencies such as the CIA, NSA and DIA are working on authenticity issues currently.
The tape message was posted on the same day that George Bush, the US president, wrapped up a tour of the Middle East.
Bush had angered many Muslims by lavishing the Jewish state with praise on its 60th anniversary, hailing it as a "homeland for the chosen people". A large majority of Muslims strongly condemn Israel's existence because prior to Israel being a state it was the home of Palestinians and was simply given to Jews to form a country through a U.N. Resolution.
Microsoft in talks with Yahoo again! Don't they learn?

Well according to the Associated Press, Microsoft is now trying to buy just a portion of Yahoo or broker some kind of deal similar to the deal that Google made with AOL a few years ago.
I honestly do not think even if Microsoft outright purchased Yahoo that it would provide the advantages that Microsoft executives believe it will. Yahoo most definitely offers a excellent variety of services and web properties but at the same time among the Yahoo user base is a most likely large group of individuals who are rebellious against Microsoft products. I speak of people who prefer Linux and Unix of Windows or those who prefer MySQL over MS Access and those who prefer Google Docs over Microsoft Office.
Microsoft has to take into consideration that if it became a partner or started some sort of business alliance with Yahoo or outright purchased Yahoo that the Yahoo user base would become divided.
Yes, some loyal Yahoo users would stay but I am sure a really sizable portion of Yahoo users who have a sour taste in their mouth's for Microsoft would abandon ship and head to Google or some other place to meet their needs. I believe strongly if Microsoft purchases Yahoo that the value of Yahoo upon purchase will immediately become lesser due to loss of users.
Also, it is quite apparent that Microsoft is trying to get control over Yahoo in an attempt to have a chance at competing with Google. But I assure you Google has the cash flow to go on a shopping spree in response and purchase startups and existing Internet companies to deflect this attempt by Microsoft.
Google is already catching up to Yahoo by expanding it's offerings and services and most Google products in my opinion are far superior to the Yahoo counterparts.
Did your subway ride get delayed by a chicken?
Posted by Benjamin Kerensa | 5/18/2008 11:16:00 AM | News, Personal, San Francisco | 0 comments »If you were riding the inbound N-Judah Muni train this morning you were probably delayed due to a incident involving a fierce chicken attacking people in the Powell Station in San Francisco.
Apparently someone released a chicken in the station and it made it's way down to the tracks and stirred up a whole mess of trouble.
I personally took the N-Judah on my way back from the Bay to Breakers marathon which had a host of runners wearing everything from multi-colored wigs to lingerie.
Unfortunately I was not going to the Powell station itself but instead I got off at Civic Center. On a side note Google now has it's own branded trains in San Francisco where it displays full advertisements which wrap the entire trains.

A certain group of websites maintained and owned by Frank Arena, Jeffrey Hirst and Aaron Case all of the Kansas City, MO area.
In substance the complaint is to allege that all three parties knowningly appropriated copyrighted material of SyndicatedElitist.com for their own profit in violation of the Commons License that SyndicatedElitist.com issues content under. Further the complaint alleges extortion, fraud, threats and that Frank Arena, Jeffrey Hirst and Aaron Case all currently run a gambling system within the United States and via an Instrument of Interstate Commerce which is a violation of the United States Code whether it be for money, credits or similar tokens.
This suit will be filed in the United States District Court for the Northern District of California. We are requesting relief in a injunction, monetary reward and fines. The laws being violated by these persons are in fact both punishable by criminal and civil penalties and the law is quite clear in these statutes.
Upon filing the case GKG.net will under ICANN regulations be required to freeze the domain names of the parties listed above once they are provided a certified copy of the complaint filed.

Title 17 U.S.C. § 1309, Title 18 U.S.C. § 875(d), Title 18 U.S.C. § 1084(a), Title 18 U.S.C. § 1832(a)(5)

Well so far today has been very relaxed for me and I plan on attending the Bay to Breakers
marathon this weekend. I had a little free time after lunch at Tommy's Joynt
which has some of the best sandwiches in the entire world and anyways I had my taxi stop at the Bill Graham Auditiorium and I entered the expo.
Anyways I am just doing a little catchup work on some backend XML coding for my blog and looking at my daily statistics for my blog.
California Supreme Court Says Gay Marriage is legal!

Even though there was a great divide among the California State Supreme Court the court still came to the conclusion today that "Gay Marriage" cannot be prevented as it disenfranchises individuals and discriminates against a class of people.
The California Supreme Court this morning legalized same-sex marriage for all citizens of the State of California.
In a 4-3 ruling written by Chief Justice Ronald George, the Supreme Court struck down California laws that restrict marriage to heterosexual couples, finding that it is unconstitutional to deprive gays and lesbians of the equal right to walk down the aisle with a marriage license in hand.
The likelihood of this decision being reversed at the U.S. Supreme Court level is very unlikely and it is likely that even more contests will be held in court systems around the country trying to remove similar bans on same-sex marriage in other states.
Mayor Gavin Newsom of San Francisco definitely made the right decision by allowing same-sex marriages in San Francisco until they were stopped simply because he made a clear message that San Francisco will do what is right and will not discriminate against certain groups of people.
A spokesman for San Francisco Mayor Gavin Newsom sent a simple e-mail to his press staff: "We won."
California officials had defended the current law, despite the fact that both former Attorney General Bill Lockyer and current Attorney General Jerry Brown do not oppose gay marriage. State lawyers have argued that California's strong domestic partners laws essentially already provide equal benefits to same-sex couples, eliminating the need to tamper with the traditional definition of marriage laws.
The Supreme Court has now decided that the state officials and state lawyers were wrong and that supporters of same-sex marriage and the Mayor of the City of San Francisco was in fact correct.
I personally do not have any standing opinion on the matter other than the fact I believe in equal rights for all and I think in this situation the ban just had to go.

At approximately 5:30pm my wife Jacklyn Kerensa who is also a associate editor was walking through the City Hall area when she noticed a large group of San Francisco Police and City Fire and Ambulances surrounding and cordoning off the entire City Hall and Civic Center Park area.
Apparently NBC 11 News was on scene and my wife Jacklyn approached law enforcement to inquire as to what was going on and was told that a security threat had been identified at City Hall possibly related to a explosive device or some other suspicious item and for precaution the City had called in all the available response it could.
So far the city is not providing any official statement as to what exactly occurred although Syndicated Elitist is the only site at all with any mention of this incident. I would imagine more information will be available through local news outlets such as NBC 11 and KRON with in the next few hours and as I get more information I will provide a update.

The Great Annoyance
Posted by Benjamin Kerensa | 5/06/2008 05:31:00 PM | Opinion, Personal, Site Updates, Technology | 0 comments »I like to keep my frequent visitors updated as to the technical aspects of my website and as such I am making this post to inform my readers of some recent security issues that have occurred on my blog and the servers that provide the services which allow my blog to function.
First, starting on May 4th and up till today my blog’s network layer had a number of abusive activities recorded which originated from a group of users on the Distributed.net IRC Network. In my diligent attempts to keep my servers secure which provide a number of services to my blog which allow it to function properly and efficiently I made a dutiful effort to track and identify each individual source.
By analyzing my server logs and using various methods and techniques I was able to identify they network and actual physical sources of each attempt to exploit my servers and or abuse the services provided. No actual damage resulted and nor was any real threats identified.
Instead the group of users were port scanning my servers and doing comment spamming on my blog probably as a attempt to irritate me. In response to this activity each IP Address and Hostname associated with the identified activity was forwarded to the abuse contacts for each upstream provider associated to the IP addresses and Hostnames.
Distributed.net is a small distributed computing project founded by David McNett and currently is defunct due to it not having any monetary rewards which would motivate it’s users to continue the project. The likelihood of this site and organization still being around in a few years is minimal since it’s competition is vast and it’s overall market share of distributed computing is dwarf in comparison to BOINC and other projects.
As a result of the activity that has occurred over the last few days I will be more patient in my analysis of my server logs and will continue to report any activity which is malicious in nature. If need be I will simply apply bans to IP Addresses and Hostnames which pose annoyance and or interruption in any service.

New Open Source Project for Academia

This system will also include a C++ based application which can run on Windows, Linux and Unix environments for mobile scanners to easily update inventories around the library.
In addition to the Web Based front-end I will also create a Windows Application which will tie into the system and also allow control of public Internet terminals in Libraries which library users can reserve a period of time to use a computer.
Currently a large majority of libraries pay a flat fee or subscription based fee's to software developers to use similar software.
I will release this Open Source under the GNU License and it will be available for download on SourceForge.net in the weeks to come.
Boycott Jackie Chan!
Posted by Benjamin Kerensa | 5/04/2008 07:00:00 PM | Opinion, Politics | 3 comments »Jackie Chan (成龍) delivered the Olympic Torch back to China today. The Olympic Torch which has been protested in it's journey through a variety of countries has become a symbol to many of tyranny and torture.
China for years has been condemned worldwide as a country which deprives it's citizens and people who live and work there of basic human rights. Over the years hundreds of individuals have been imprisoned and tortured for expressing their opinion or just doing their job as a journalist or reporter.
China has a tight hold on it's citizens whom do not enjoy the same freedoms and rights most countries offer their citizens.
I am going to be the first person to suggest a Boycott of Jackie Chan films and merchandise. I think Jackie Chan is an excellent actor and has made many outstanding films but I cannot through my viewing of his films and purchase of his merchandise support him anymore because I think his participation in the Torch Relay is unacceptable since his home country has not made any real effort to advance human rights in it's country.
My blog is the first Internet site to publicly suggest that Jackie Chan be Boycotted and I hope that other blogger's and Internet communities and other organizations will follow my lead in this initiative which perhaps will bring more attention to the need for human rights in China.
I further also believe China needs to have fair and open talks with the Dalai Lama not just his aides. If Jackie Chan through his publicist or in any public area speaks out against the Human Rights violations in China I will resume viewing his films and consider purchasing his merchandise but until he speaks out against the terrible acts I will Boycott him.
